Terms of Service

These Terms of Service ("Terms") govern your access to and use of DistillAI, a desktop application ("DistillAI," "we," "us," or "our"). By downloading, installing, or using DistillAI, you agree to these Terms. If you don't agree, don't use the app.
1. What DistillAI Is
DistillAI is a Windows desktop application that lets you interact with multiple third-party AI chat providers from a single interface, including automation features (referred to in-app as "AI Valet") that carry out tasks across those providers on your behalf. DistillAI is not affiliated with, endorsed by, or sponsored by any AI provider it connects to.
2. Eligibility and Accounts
You must be at least 18 years old to use DistillAI. When you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. Let us know right away if you suspect unauthorized use.
3. Trial, License, Subscriptions, Billing, and Payment
DistillAI offers a free trial, a one-time DistillAI 1.x software license, and monthly Starter, Pro, and Power subscription plans. Current prices, cloud allowances, funded AI Analysis allowances, included models, and license details are described in our Service & Data Policy, which forms part of these Terms.
Subscription and license payments are processed by Stripe; we don't store your full card details ourselves. Monthly subscriptions renew automatically at the then-current price until you cancel. You can cancel through the in-app subscription management link, which opens Stripe's Customer Portal.
After fifteen paid subscription months across eligible tiers, the DistillAI 1.x license is earned at no additional cost, as described in the Service & Data Policy. We may change pricing going forward; if we do, we'll give reasonable notice before a change applies to a future subscription renewal where practicable.
4. Cancellations and Refunds
You can cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and you keep access until then. We don't currently offer automated refunds. If you believe you're owed one — for example, a billing error or a service outage — contact us at app-sales@distillai.software and we'll review it case by case.
5. Bring Your Own Key (BYOK)
DistillAI lets you optionally connect your own API keys for third-party AI providers ("BYOK"). If you do, you're solely responsible for that provider's costs, rate limits, and terms of service. Your BYOK keys are encrypted and stored only on your local device — DistillAI does not transmit them to, or store them on, our servers.
6. DistillAI-Funded AI Analysis
Depending on your trial or subscription plan, DistillAI may provide a limited allowance of AI Analysis usage funded by us rather than your own API credentials. Trial usage is a one-time allowance; subscription allowances reset each billing period and do not roll over unless we expressly state otherwise. Current allowances and included models are described in the Service & Data Policy.
We may throttle, limit, or suspend funded usage if we reasonably believe it is being abused, including attempts to circumvent account, device, trial, or plan limits.
7. Third-Party AI Providers
When you use DistillAI to interact with a third-party AI provider — through a signed-in provider website session, your own API credentials, or DistillAI-funded AI Analysis — you're also subject to that provider's own terms, policies, account requirements, and availability. It's your responsibility to comply with them. Any subscription or account charges imposed directly by a third-party AI provider remain between you and that provider.
Some DistillAI features interact with provider websites directly. Providers may change their sites, authentication, limits, models, or policies without notice; those changes may temporarily or permanently affect a DistillAI feature. We aren't responsible for a provider's service interruption or for actions a provider takes against your account with them.
8. Acceptable Use
You agree not to:
- Use DistillAI for anything illegal, or in a way that violates a third-party provider's terms of service;
- Attempt to reverse-engineer, decompile, or circumvent any technical limitation of the app;
- Abuse, automate, or circumvent DistillAI-funded usage limits (for example, creating multiple accounts to bypass trial or plan limits);
- Resell, sublicense, or provide access to DistillAI to others without our written permission.
We may suspend or terminate your account if we reasonably believe you've violated these Terms.
9. Your Content
You retain ownership of the chat content, prompts, and data you create or import while using DistillAI. We don't claim ownership over it. See our Privacy Policy and Service & Data Policy for how that data is handled, stored, limited, and retained.
10. Data Retention and Inactive Accounts
DistillAI generally retains cloud data while an account remains active and as needed to provide the service. We may establish reasonable retention periods for accounts that have been inactive for an extended period. Where practicable, we will provide reasonable notice before deleting customer content under an inactivity policy. Additional details are described in the Service & Data Policy.
11. AI Output Disclaimer
DistillAI surfaces content generated by third-party AI systems. That content can be inaccurate, incomplete, or inappropriate for your use case. You're responsible for reviewing and verifying anything you rely on before acting on it.
12. Disclaimer of Warranties
DistillAI is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the app will be uninterrupted, error-free, or available at all times.
13. Limitation of Liability
To the maximum extent permitted by law, DistillAI won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including loss of data, profits, or business, even if advised of the possibility of such damages. Our total liability for any claim relating to DistillAI won't exceed the amount you paid us in the twelve months before the claim arose.
14. Termination
You may stop using DistillAI and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service, with reasonable notice where practical.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app. Continued use after a change means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
